Our Ten Privacy Principles

As part of our commitment we have established Ten Privacy Principles that govern our actions as they relate to the use of Personal Information. These principles have been built upon the values set by the Canadian Standards Association's Model Code for the Protection of Personal Information and Canada's Personal Information Protection and Electronic Documents Act.

1. Accountability
Catlin Canada is responsible for maintaining and protecting the Personal Information under its control, and in fulfilling this mandate, we shall designate one or more individuals to be accountable for our compliance with these principles.

2. Identifying Purposes
The purposes for which Personal Information is collected shall be identified before or at the time the Personal Information is collected.

3. Consent
The knowledge and consent of the individual shall be obtained for the collection, use or disclosure of Personal Information, except where required or permitted by law.

4. Limiting Collection
The personal information we collect shall be limited only to that which is necessary for the purposes identified.

5. Limiting Use, Disclosure and Retention
Personal information shall only be used or disclosed for the purposes for which it was collected, unless an individual has otherwise consented or when it is required or permitted by law. Personal information shall be retained for the period of time required to fulfill the purpose for which it was collected.

6. Accuracy
Personal Information shall be maintained in as accurate, complete and up-to-date form as necessary to fulfill the purpose for which it is to be used.

7. Safeguards
We shall protect personal information using security safeguards that are appropriate to the sensitivity of the Personal Information received.

8. Openness
Catlin Canada will make specific personal information available to individuals concerning the policies and practices that relate to the management of their information.

9. Individual's Access
On written request to our Privacy Officer, an individual will be informed of the existence, use and disclosure of their Personal Information that is under our control, and may be given access to that personal information as required and permitted by law. Individuals are entitled to challenge the accuracy and completeness of that personal information and request that it be amended, if appropriate.

COLLECTING, USING AND SHARING PERSONAL INFORMATION

Why we collect and use personal information

The collection of personal information is an integral part of providing products and services that our client’s needs. While the personal information we collect may come directly from you, it may also be provided by our affiliates or other third parties, such as including (but not limited to) Dun & Bradstreet, Insurance Bureau of Canada, Crawford Adjusters Canada Inc., McLarens Brouwer International, a division of Ponton Coleshill Edwards & Associates Insurance Adjusters Limited, Technical Risk Services, Slingshot Inc. and Lloyd’s of London.

Personal information may be collected and used for the following purposes:

  • Establishing and maintaining contact with you;
  • Assessing eligibility for cover, processing and maintaining coverage, renewal of cover or related products and services;
  • Effectively analyzing, assessing and underwriting risks;
  • Responsive assessment of Clients' ongoing needs and proposals for future products and services to meet those needs;
  • For billing and accounting services relating to our products and services;
  • For client communication, service and administration
  • For the investigation, settlement and payment of claims, legal, valuation services and determining eligibility for benefits;
  • For internal, external and regulatory audit purposes;
  • Meeting legal, security, processing and regulatory requirements;
  • To share or exchange reports and information with credit reporting agencies, credit bureaus, and any other person, corporation, firm or enterprise to verify the accuracy of personal information;
  • Compiling statistics for analyzing our business.
Personal information may also be used for other purposes, subject to obtaining your prior consent for such use.

What Information Do We Collect

  1. Information provided on applications or other forms
  2. Information acquired through third parties such as government agencies, industry associations, auditors, and insurers
  3. Information received from consumer reporting agencies

Consent to use personal information

Personal information may be obtained with your express consent or such consent may be implied by the circumstances.

When Personal information is provided by you to us for the purpose of allowing us to perform or provide a certain service or product, the provision of such information to us authorizes our collection, use and disclosure to appropriate third parties of such information for said purposes. We may also retain this personal information for as long as it may be required for said purposes.

Upon receipt of such Withdrawal Notice we will inform you of the consequences of your withdrawal of consent. Our response time to Withdrawal Notices is normally within 30 days. In some cases, refusing to provide certain Personal Information or withdrawing consent for us to collect, use or disclose Personal Information could mean that we cannot provide coverage or other requested products, services or information.

Sharing personal information

We do not sell Personal Information to third parties. In providing our services we may need to share certain Personal Information we collect to underwriters, credit agencies and 3rd party service providers with whom we contract such as lawyers, claims adjusters and other experts.

If required or permitted to do so by law, we will disclose Personal Information to third parties without obtaining your prior approval or providing you with notice.

We may also use this personal information to assess your future needs and to offer the products and services that may best meet those needs, from ourselves, our affiliates or reputable organizations selected by us. If you do not wish to receive these offers or such information, please contact our Privacy Officer as outlined below in the contact information section.

Accuracy of Personal Information

We shall use our best efforts to ensure that Personal Information under our control, including information what we disclose to third parties in accordance with this Privacy Policy, is accurate, complete, and up-to-date as is necessary for the purposes for which it is used.

You may access, verify and change Personal Information kept with us at anytime. Please keep us informed of any changes in your Personal Information.

Security of Personal Information

We restrict the use of Personal Information to the purpose we identify when that Personal Information is collected and access to Personal Information is limited to those employees of Catlin Canada who require access to it provide services you need. We protect Personal Information from unauthorized access through the implementation and use of physical and procedural safeguards which are appropriate to the level of sensitivity of the information collected.

Strict standards and policies are in place to ensure that our employees treat Personal Information with great care and respect. Our service providers and agents are also required to maintain Client confidentiality, and may not use the information for any unauthorized purpose.

Privacy and the Internet

Catlin Canada may collect user information from its websites (for example, via cookies which are alphanumeric identifiers transmitted from a website to a visitor's browser and IP address). This information is used solely for enabling us to provide you with a customized online experience and to find ways to improve our site. Although cookies are widely used, it may be possible to disable cookies via your browser settings. However, in so doing, some websites may not function properly or optimally.

Catlin Canada websites may contain links to other third party sites that are not governed by this privacy policy. Although we endeavor to link only to sites with high privacy standards, our Privacy Policy will no longer apply once you leave this website (www.catlincanada.com). We are not responsible for privacy policies employed by other third parties since they would be governed by privacy legislation applicable in their country of residence. We suggest, therefore, that you examine the privacy statements of those sites to learn how personal information may be collected, used and/or disclosed.
